ROOKIE ACADEMY LAKE WANAKA LIMITED
TERMS & CONDITIONS (NEW ZEALAND)

These Terms & Conditions apply to all courses, camps, training programmes, and related services provided in New Zealand by Rookie Academy Lake Wanaka Limited (“Rookie Academy”, “we”, “us”, or “our”).
By making a booking, submitting payment, or participating in a programme, you agree to be bound by these Terms & Conditions.
By clicking to confirm your booking and submitting payment, you expressly acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions and the Assumption of Risk & Liability Waiver.
1. BOOKINGS & CONTRACT FORMATION
1.1 A booking is confirmed only once we have received the required payment and issued written confirmation.
1.2 The person making the booking confirms that they have authority to accept these Terms & Conditions on behalf of all participants included in the booking.
1.3 The person making the booking accepts full financial responsibility for all participants in the booking group.
1.4 All programmes and services are subject to availability.
2. PAYMENT
2.1 A non-refundable deposit of 6.5% of the total booking value is payable at the time of booking.
2.2 Deposits are non-refundable except where required by New Zealand law.
2.3 The balance of fees must be paid by the due date specified in the booking confirmation.
2.4 Failure to pay by the due date may result in cancellation of the booking without refund of any amounts already paid.
2.5 Prices are stated in New Zealand Dollars unless otherwise specified.
2.6 Any bank fees, international transfer fees, currency conversion fees, or intermediary charges are the responsibility of the purchaser.
3. ACCURACY OF INFORMATION
3.1 We take reasonable care to ensure that information and pricing are accurate at the time of publication.
3.2 Errors and changes may occur. You must confirm all programme details prior to booking.
4. ASSUMPTION OF RISK
4.1 Skiing, snowboarding, and mountain activities involve inherent risks, including the risk of serious injury or death.
4.2 By participating, you voluntarily assume all risks associated with participation, whether known or unknown, to the fullest extent permitted by law.
4.3 Nothing in these Terms excludes or limits any rights you may have under the Consumer Guarantees Act 1993.
5. INSURANCE
5.1 We strongly recommend that all participants obtain comprehensive travel and medical insurance appropriate to their activities and location, including for domestic programmes.
5.2 Participants are responsible for their own insurance arrangements.
5.3 To the fullest extent permitted by law, Rookie Academy is not responsible for losses that would ordinarily be covered by insurance.
6. PROGRAMME CHANGES & CONDITIONS
6.1 Programme schedules, locations, content, trainers, and duration may change due to weather, snow conditions, safety considerations, fatigue, lift operations, or other operational requirements.
6.2 Training may be stopped, modified, or cancelled where we consider it unsafe or inappropriate to continue.
6.3 Completion of three (3) hours of training in a day constitutes a full training day.
6.4 Missed training days, early departure, or programme modifications do not entitle participants to refunds or credits.
7. MINIMUM ABILITY LEVELS
7.1 Each programme has minimum ability and fitness requirements.
7.2 If a participant does not meet the minimum requirements, we may modify the programme or require alternative training arrangements at the participant’s cost.
7.3 No refunds are provided where ability levels are misrepresented.
8. BEHAVIOUR & REMOVAL
8.1 Participants must comply with all safety instructions, resort rules, and applicable laws.
8.2 We reserve the right to suspend or remove any participant whose behaviour:

Poses a risk to themselves or others
-
Disrupts the programme
-
Breaches these Terms or resort rules
8.3 Removal from a programme does not entitle the participant to any refund.
9. ACCOMMODATION & PROPERTY DAMAGE
9.1 Participants are responsible for any damage caused by themselves or their visitors.
9.2 Participants agree to indemnify Rookie Academy for any loss, damage, or claim arising from their conduct, to the fullest extent permitted by law.
10. CANCELLATIONS BY YOU
10.1 All cancellation requests must be submitted in writing.
10.2 Cancellation fees apply as follows (based on programme start date):

60 days or more: loss of 6.5% deposit

30–59 days: 75% of total booking cost including 6.5% deposit

Less than 14 days: 100% of total booking cost
10.3 No refunds are provided for:

Injury, illness, fatigue, or personal circumstances
-
Weather conditions or mountain closures
-
Missed training days or early departure
-
Cancellations after a programme has commenced
10.4 Where we are unable to deliver services due to circumstances beyond our control, we may offer a credit at our discretion, subject to applicable law.
11. FORCE MAJEURE
11.1 We are not liable for failure or delay in performing obligations due to events beyond our reasonable control, including severe weather, natural disasters, government action, or resort closures.
12. PHOTOGRAPHY & MEDIA
12.1 We may capture photographs or video during programmes for promotional purposes.
12.2 You grant us a non-exclusive, royalty-free licence to use such media unless you notify us in writing prior to the programme.
13. GOVERNING LAW
These Terms & Conditions are governed by the laws of New Zealand.
14. SEVERABILITY
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
